Conditions of Enrolment & Rules

It is important for you to carefully read and understand the conditions of enrolment and school rules. If you have any questions or need help to understand them, ask your agent, retailer or somebody proficient in English to translate and explain them to you.

1. Registration

A Registration fee of NZ$235 (USD$169) is payable once only on your first application. It covers the processing of your registration.

2. Accommodation

The Placement fee of NZ$195 (USD$140) and the first 4 weeks of pre-paid accommodation is non-refundable. Dynaspeak English acts only as an agent in arranging and paying for homestay or other accommodation. All periodic payments to accommodation providers are subject to a variable administration charge of 5-20%. The unused portion of all pre-paid accommodation fees after the first month will be refunded if you find other accommodation. You must give written notice to Dynaspeak English of your intention to leave your accommodation. The notice period required for homestay is 3 weeks. Other notice provisions and terms may apply for other types of accommodation. Your homestay fee pays for accommodation, daily breakfast and dinner, and lunches at weekends. Other accommodation options do not include any meals. Unless otherwise agreed by Dynaspeak English, you must leave your accommodation within 1 week of the end of your Dynaspeak English course.

3. Payment and Course Changes

Course fees are accepted for lessons within the period specified at the time of payment. No fees paid will be credited to later classes or refunded if the student is absent for any period or for any other reason. Fees are not transferable.
Payment may be made in cash (New Zealand currency), by cheque or bank draft, or by telegraphic transfer to the following account: Westpac Bank (79 Queen Street Branch) #030104 0198904-001 (Dynaspeak), Auckland, New Zealand. Payment may be made using JCB CARD, DINERS, MASTERCARD, VISA and AMERICAN EXPRESS credit cards.
Course fees must be paid in full by 1:00p.m. on the Thursday preceding either the commencement date of your course, or the expiry date of your current payment period.

4. All Course Costs

All prices given in this brochure are the total course cost and include Goods and Services Tax of 12.5%, but external exam fees are not included. Students are also required to pay their own bus fares on public transport when participating in organised extra-mural class activities within Auckland (e.g. visiting cultural attraction with teacher).

5. Mainstream Immersion, Elective and FAV Classes

Dynaspeak may at any time substitute general English classes for mainstream immersion, Elective or FAV classes or tutorials if regular staff are unable to provide scheduled lessons for any reason.

6. Class Placement

Entry to any Dynaspeak English class or option, and award of certificates and recommendation for further study placement, are only permitted to students who have reached an appropriate attendance and achievement standard as determined by Dynaspeak in its sole discretion. Availability of courses is subject to enrolment.

7. Cancellation and Withdrawal

A. All Students
If you cancel your course before arrival in New Zealand and more than 14 days before the course commencement date, or if you are not granted a requisite visa to study in New Zealand, Dynaspeak will refund the course fee less the Registration and Placement fees.

B. Cancellation or withdrawal within 14 days prior to starting date or after arrival in New Zealand.
Dynaspeak English will refund the following: 1-5 week courses: 50% of tuition fees for cancellations in the first 2 days; 6-12 week courses: 75% of tuition fees for cancellations in the first 5 days; 13+ week courses: all tuition fees except for 10% of your total tuition fee or NZ$500 (USD$360) whichever is the lesser for cancellations in the first 8 consecutive days.

C. After the first 8 consecutive days from commencement of your course: Subject to notice requirements, Dynaspeak English will refund any unused homestay fees. No other fees can be refunded.

All notifications of intention to withdraw, cancel or change a course must be in writing, in English, and received by Dynaspeak within the relevant time period required.
Any refund of course fees shall be made to the original payer of those course fees, unless otherwise directed. Before a refund is made you will be asked to provide evidence you have changed your visa status or left New Zealand. Immigration authorities will be notified.

    8. Acceptance of Conditions, School Rules, Homestay Rules and Consequences

    By applying to join the Dynaspeak English Course, the student accepts these Conditions and the Rules as published or amended by Dynaspeak English, and any additional Regulations established by Dynaspeak English. Breach of any Condition, Rule or Regulation, or failure to comply with New Zealand law, may result in the suspension or expulsion of the student and forfeiture of fees. No refund will be given.

    9. Personal Information

    Subject to the provisions of the Privacy Act, 1993, personal information collected by Dynaspeak English either during the application process or subsequently may be stored and used for the purposes of the school's administration, shared with other institutions or authorities and exploited for the purposes of promotion and publicity. The school may use photographs taken during the school's activities for publicity purposes.

    10. Complaints Procedure and Governing Law

    If a dispute arises, a Problem Resolution form is available from the school reception. If the matter cannot be resolved by discussion with the Director or staff, complaints can be lodged with English New Zealand (PO Box 2577, Auckland), the New Zealand Qualifications Authority (PO Box 160, Wellington) or your solicitor. Any dispute shall be resolved in the New Zealand courts under New Zealand law.

    11. Protection of Student Fees

    All Dynaspeak English students are protected by a Static Trust Account administered by independent solicitors Ryken and Associates. The contact details of the Trust administrator are available by calling the 24 hour English New Zealand Hotline (0800 106 108) or DJ Ryken, Solicitor (09 356 7370) in the unlikely case of a closure event.

    12. No Liability

    Dynaspeak takes care to help you enjoy your stay in New Zealand. It is essential to insure your health and personal property for the duration of your stay. Dynaspeak will not be responsible for any loss, damage or injury to persons or property or suffered by you whether at school, during excursions or with a homestay family, except where liability is imposed by New Zealand law. Dynaspeak reserves the right to vary course details, prices and dates without notice and will not be liable if published courses or contracted services cannot be provided.

    13. Eligibility for Health Services

    Most international students are not entitled to publicly funded health services while in New Zealand. If you receive medical treatment during your visit, you may be liable for the full costs of that treatment. Full details on entitlements to publicly funded health services are available through the Ministry of Health, and can be viewed on their website at www.moh.govt.nz.

    14. Accident Insurance

    The Accident Compensation Corporation provides accident insurance for all New Zealand citizens, residents and temporary visitors to New Zealand, but you may still be liable for all other medical and related costs. Further information can be viewed on the ACC website at www.acc.co.nz.

    15. Rights Reserved

    Dynaspeak reserves the right to alter prices or any of the terms or conditions described in this brochure without notice at any time and to deny enrolment to any person without explanation.

    School Rules

    * Always show consideration to other students, your teachers, other staff and visitors.

    * You must attend all classes and compulsory Tutorials. In special cases if you have to be absent, speak to Reception, who can then inform the Principal or the Director. If you cannot come to school because of illness you must telephone the school before 9.00am that day.

    * You must provide your current contact details (address, telephone, email) and notify Reception of any changes immediately.

    * Never smoke in the building including corridors, stairwells and restrooms. The only smoking area for students is outside at the back of the building, accessed through the Carpark (Level C). Do not block the Carpark entrance. No smoking is permitted inside the Carpark.

    * You must go to class on time. You will not be allowed to enter class if you are late. If you arrive late, please report to Reception.

    * If you miss one hour of lessons without permission, you may not be allowed to attend the next hour.

    * If you are absent more than once without permission, you may forfeit a day, or even a week's lessons, without compensation.

    * Only English can be used in the classrooms at any time. If you speak another language you may be asked to leave. It is also polite to try and speak English outside lesson times in the presence of other people who don't understand your language.

    * You must follow the directions of the teacher at all times. If you disagree with a teacher, tell Reception afterwards and an appointment will be arranged for you to discuss your problem. If your problem is serious, please complete a Problem Resolution Form at the Reception.

    * Do not enter any classroom before the class start time. You must leave the classroom immediately after the lesson has finished. You may only be in the classroom during your lesson, not during the break times.

    * You must not take recording equipment or any electronic device into any classroom at any time.

    * Mobile phones MUST be switched OFF at all times during the lesson. If your phone sounds, you will be asked to leave immediately. It is considered extremely bad manners to interrupt your class with a phone, bleeper or other disturbance.

    * You must NEVER bring weapons or dangerous materials of any kind to school, including knives.

    * No bullying, fighting or play-fighting is permitted within the school. You are responsible to take care of school property and exercise caution near windows and glass panels.

    * No food or drink to be taken into any classroom, the library or near the computers.

    * The Library is a quiet area for studying. If you want to chat, please go to the student lounge.

    * You must never enter the Staff Room nor occupy the Reception area (it is reserved for guests).

    * You may not use any of the school's business phones. A payphone is available in the Lounge.

    * You must never remove books, magazines or school property from classrooms, the Library or from the school generally. Theft will be immediately reported to the police. You could be expelled from school without compensation.

    * You must prepare your vocabulary in advance of your Mainstream Immersion Class everyday and self-correct your DYNASPEAK dictations from your Mainstream Immersion Class after your lesson.

    If you have any kind of problem PLEASE speak to Reception first. If they cannot resolve your problem, they will find someone who can.

    If you break any rule you will receive a "Yellow Card" as a formal warning explaining what you have done wrong. It will tell you what you have to do and also the consequences if you break any rules again. If you do break any rules again, you will be given a "Red Card". This means you will be called to a meeting to discuss the problem. In some cases, parents, guardians or agents may be informed of your behaviour. To receive a Red Card is very serious and may result in punishment, expulsion or even action which could lead to the cancellation of a study permit.
